Terms & Conditions
Introduction
These Terms and Conditions apply to all use of this website and to all agreements between Maxime Velthuis and the customer.
By using this website or purchasing artwork, you agree to these Terms.
Nature of the agreement
This website is used to present artwork. Purchases are arranged directly between the Artist and the Customer via written communication (e.g. email or contact form).
An agreement is concluded when:

The Customer confirms the purchase in writing, and

The Artist confirms the order

Offers are non-binding, unless otherwise stated.
A fee of €50 will be charged for an oriënting appointment. During this appointment, the desired artwork will be discussed and Maxime Velthuis will provide advice to support the process. This payment is non-refundable and will be deducted from the final invoice.
Artwork and artistic Nature
All works are original artworks unless stated otherwise.
The Customer acknowledges that:

Each artwork is unique

Minor imperfections are inherent to artistic creation

Colors and appearance may vary slightly due to screen settings
Intellectual property and usage rights
All intellectual property rights remain with the Artist.
Purchasing an artwork does not transfer copyright.
The Customer:

May display the artwork privately

May not reproduce, distribute, or commercially exploit the artwork
Any use beyond private ownership requires prior written permission from the Artist.
The Artist retains the right to:
Use images of the artwork for portfolio, promotion, and exhibitions
Pricing and costs
Prices are stated in EUR unless otherwise agreed.
Prices may exclude:

Shipping costs

Additional expenses (e.g. custom packaging, insurance)
All prices are subject to change until an agreement is confirmed.
Payment
Payment is made via bank transfer.

Payment details will be provided after confirmation

Payment must be completed within 14 days unless agreed otherwise
The Artist may request full or partial prepayment.
Ownership of the artwork remains with the Artist until full payment has been received.
Delivery and risk
Delivery terms are agreed individually.

The Artist is not liable for delays caused by third parties
Risk of loss or damage transfers to the Customer upon shipment.
Cancellation and termination
If the Customer cancels an order after confirmation:

The Artist is entitled to compensation for work already performed

For custom or commissioned work, cancellation may result in partial or full payment being due
Right of withdrawal (EU Consumers)
Consumers in the EU may withdraw within 14 days, except for:

Custom-made or personalized artworks
Withdrawal must be communicated in writing.
Complaints
Complaints must be submitted in writing within:

48 hours for visible damage upon delivery
-
10 days for other issues
If no complaint is submitted within this period, the artwork is deemed accepted.
Liability
The Artist is only liable for direct damages resulting from proven failure to perform obligations.
The Artist is not liable for:

Indirect or consequential damages
-
Loss of profit or business
Liability is limited to the purchase price of the artwork.
Force Majeure
The Artist is not liable for delays or failure due to circumstances beyond reasonable control, including:

Shipping disruptions
-
Illness
-
External events
Obligations may be suspended during such events.
Confidentiality
Both parties agree to treat shared information as confidential where appropriate.
Applicable Law
These Terms are governed by Dutch law.
Disputes will be submitted to the competent court in the Netherlands.
Final Provisions
If any provision is found invalid, the remaining provisions remain in effect.
